E-Bike Laws in Poway, California

Last verified September 28, 2026·San Diego County·Edited by Stacy Yamaoka Anderson

Poway's ordinance, Poway Municipal Code Chapter 10.57 (ELECTRIC BICYCLES), was formally adopted at a February 2026 Council meeting. It is broader than the state pilot's default: persons under 12 may not operate e-bikes of any class, where Veh. Code § 21214.7 authorizes only a Class 1 and 2 restriction. Under-16s may not operate Class 3, under-18s may not carry passengers, and helmets are mandatory for all riders under 18. E-bikes are prohibited on sports courts, athletic fields, passive lawn areas, water detention basins and business-district sidewalks, plus playgrounds, parks and school grounds not designated as bike paths. Enforcement is warnings first, then fines, with confiscation of non-compliant e-bikes.

Chapter confirmed, section text and fines not

Poway Municipal Code Chapter 10.57 and its title are confirmed in the Poway code structure. But the ordinance number, the section-level text within Chapter 10.57 and the fine amounts could not be found — the city's civic alerts page and the code chapter text were both inaccessible.

Going broader than the statute allows?

Veh. Code § 21214.7, the AB 2234 pilot authority, permits San Diego County jurisdictions to bar persons under 12 from operating a Class 1 or Class 2 electric bicycle. Poway's rule is reported as covering e-bikes of any class.

In practice this makes no difference, because Class 3 already carries a statewide minimum age of 16 under § 21213(a) — a rule covering "all classes" is redundant as to Class 3, not broader in effect.

But it is worth noting as a drafting matter. A local ordinance that exceeds its enabling statute's scope is vulnerable on the excess, and Coronado's rule is reported the same way. The safe reading is that the under-12 rule bites on Class 1 and Class 2, where the statute authorizes it.

Water detention basins

Poway's prohibited-areas list includes water detention basins, which is an oddly specific inclusion until you recognize the pattern. Carlsbad's CMC § 10.56.020 prohibits riding on public drainage facilities; Seal Beach's SBMC Ch. 7.65 covers public drainage facilities, culverts, ditches and channels; Encinitas's EMC § 9.50.010 names drainage facilities.

These are the concrete flood-control channels that riders use as informal skate parks and jump courses. They appear in four Southern California ordinances because they are a recurring and genuinely dangerous problem — steep smooth concrete, no supervision, standing water.

Sacramento County's May 2026 amendment addresses the same behavior from a different angle, targeting unauthorised off-road bicycle courses with jumps and tracks and unauthorised trail building.

Common questions

How old do you have to be to ride an e-bike in Poway?
  1. Poway Municipal Code Chapter 10.57, adopted February 2026, prohibits persons under 12 from operating e-bikes — reported as covering any class, which is broader than the Veh. Code § 21214.7 default of Class 1 and 2. Under-16s may not operate Class 3, and helmets are mandatory for all riders under 18.
Where are e-bikes banned in Poway?

Sports courts, athletic fields, passive lawn areas, water detention basins and business- district sidewalks, plus playgrounds, parks and school grounds not designated as bike paths. E-bikes are permitted on roads, bike lanes and designated paths.

Can Poway confiscate an e-bike?

Yes — the ordinance provides for confiscation of non-compliant e-bikes, with warnings for initial violations before fines. Reporting indicates that three or more infractions can lead to a facility access ban with a 30-day impoundment possible, mirroring Chula Vista's structure. The fine amounts could not be confirmed.

Can a 16-year-old carry a passenger on an e-bike in Poway?

No. PMC Ch. 10.57 prohibits anyone under 18 from carrying passengers — stricter than state law, which requires only a separate attached seat under Veh. Code § 21204(b). Chula Vista has the same rule.
