E-Bike Laws in Newport Beach, California
Newport Beach has the most fully documented e-bike scheme in California, across two chapters. On the oceanfront boardwalk — the concrete walkway from 36th Street to east of E Street — nobody may exceed 8 mph (NBMC § 12.54.030), motorized scooters are banned outright, and a Walk Zone applies at the Newport Pier plaza. Citywide, NBMC § 12.56.030 prohibits riding a bicycle or e-bike on any sidewalk except where the Council has designated it on the Sidewalk Cycling Allowed Map — and the 2025 ordinance expanded that map. Bikes are banned on the sand at city beaches. Boardwalk violations are infractions up to $200; unsafe operation is a misdemeanour up to $500.

The ordinance that tightened and loosened at once
Ord. 2025-35 — first reading November 4, 2025 (unanimous), adopted December 9, 2025, effective January 9, 2026 — is worth reading as a piece of policy design.
It tightened: a citywide sidewalk prohibition, an enumerated list of unsafe acts, impound authority, and a locally enforceable helmet rule for under-18s.
It also loosened: the ordinance expanded the Sidewalk Cycling Allowed Map, adding corridors on major arterials and collectors where inexperienced riders feel safer on the sidewalk than in traffic.
That pairing is unusual and sensible. A flat sidewalk ban pushes a nervous 13-year-old into an arterial. Newport Beach's answer was to ban sidewalk riding in general and then map the places where it is the safer option. It requires maintaining a map, which is more work than a blanket rule, and it produces a better result.
The boardwalk is the strictest part
8 mph, motorized scooters banned entirely, a Walk Zone at the pier plaza, keep-right lane discipline, and no passing at a solid centerline. The fine ceiling for a boardwalk infraction was quadrupled to $200 at an earlier point, which is why it sits above most California infraction ceilings.
Along the same coastline for comparison: Hermosa Beach 8 mph on the Strand with the motor required off, Huntington Beach 10 mph dropping to 5 with pedestrians present, Manhattan Beach 15 mph on the Marvin Braude trail, Long Beach 20 mph on the Beach Path.
The e-bike diversion program
Newport Beach's own e-bike page confirms § 12.56.060's content and adds practical detail: Class 1
and 2 capped at 20 mph, Class 3 at 28 mph with riders 16 and over, helmets under 18 or at any age on
Class 3, and an E-Bike Diversion Program for juvenile first offenders.
It also states the city's position on illegal devices bluntly: Sur-Ron and Segway-type vehicles are
motorcycles requiring registration, insurance, an M1 endorsement and a DOT helmet, with a 30-day
impound for unlicensed operation. That 30-day figure is well above the state's 48-hour minimum
under Veh. Code § 22651.08(c).
Common questions
What is the speed limit on the Newport Beach boardwalk?
8 mph. NBMC § 12.54.030 provides that no person using the boardwalk shall exceed eight miles per hour. The boardwalk is defined in § 12.54.020 as the concrete walkway 12 to 22 feet wide running from 36th Street to east of E Street. A Walk Zone applies at the Newport Pier plaza under § 12.54.060.
Can you ride an e-bike on the sidewalk in Newport Beach?
Only on the corridors the Council has designated on the Sidewalk Cycling Allowed Map. NBMC § 12.56.030 otherwise prohibits riding a bicycle or e-bike on any sidewalk, with exceptions for mobility aids, small tricycles, and City employees and contractors on duty. Ord. 2025-35 expanded the map onto arterials and collectors where sidewalk riding is safer than the roadway.
Can you ride an e-bike on the sand at Newport Beach?
No. Final Council approval on May 13, 2025 banned bikes, e-bikes, scooters and other vehicles on the sand at city beaches, including surrey cycles, with police and emergency exempt. Bikes and e-bikes remain allowed on the paved boardwalk between 36th Street and E Street at 8 mph, though motorized scooters are still barred there. Fines run up to $100, $200 and $500.
Does Newport Beach require an e-bike license?
No — NBMC § 12.56.025 licensing is voluntary, and fees are waived at City safety programs. It has to be voluntary: Veh. Code § 39002, as amended by AB 1909 in 2022, prohibits local jurisdictions from requiring bicycle licensing.
Can a first-time e-bike citation be dismissed in Newport Beach?
For a minor, yes. NBMC § 12.56.080 provides a diversion program that can dismiss a first-time minor's citation on completion, and the city runs an E-Bike Diversion Program for juvenile first offenders. For helmet violations specifically, Veh. Code § 21212(d) and § 21212(f) provide statewide off-ramps as well.
